Please read these Terms of Service (“Terms”) carefully before using the Fodify mobile application (the “App”) operated by Fodify (“we,” “us,” or “our”).
1. Acceptance of Terms
By downloading, installing, or using Fodify, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
Fodify is a dietary tracking and management tool designed to help users follow the low FODMAP diet for managing Irritable Bowel Syndrome (IBS) symptoms. The App provides:
- Food scanning and FODMAP rating lookup
- Meal, symptom, and wellness logging
- AI-powered dietary coaching
- Reintroduction protocol tracking
- Personal health insights and reports
3. Account Registration
- You must create an account to use Fodify.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate information and keep it up to date.
- You must be at least 13 years old to create an account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Health Disclaimer
FODIFY IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.
- The App is a dietary tracking tool. It does not diagnose, treat, cure, or prevent any disease.
- The AI Coach provides general information about the low FODMAP diet. It is not a substitute for professional medical advice from a doctor, dietitian, or other qualified healthcare provider.
- FODMAP ratings are based on published research (including Monash University data) but individual tolerances vary. Always verify with your healthcare provider.
- If you experience severe symptoms (blood in stool, unexplained weight loss, severe pain, fever, or vomiting), seek immediate medical attention.
- Do not disregard professional medical advice or delay seeking it because of information provided by the App.
5. Subscriptions and Payments
Free Tier
Fodify offers a free tier with limited features including a restricted number of food scans, AI coach messages, and journal history access per day/week.
Premium Subscription
- Premium unlocks unlimited scans, AI coaching, full journal history, and advanced insights.
- Subscriptions are billed through Apple App Store or Google Play Store.
- Prices are displayed in the App before purchase and may vary by region.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel subscriptions in your device’s App Store/Play Store settings.
Refunds
- Refunds are handled by Apple or Google per their respective refund policies.
- We do not process payments directly and cannot issue refunds ourselves.
6. User Content
- You retain ownership of all content you create in the App (food logs, photos, notes, chat messages).
- By using the App, you grant us a limited license to process your content as necessary to provide the service (e.g., sending photos to AI for food identification, using logs to power coaching).
- We do not use your personal content to train AI models.
- You are responsible for the accuracy of information you log.
7. AI Features
- AI features (food scanning, meal parsing, AI Coach) are powered by third-party AI services.
- AI responses may occasionally be inaccurate. Always verify important dietary decisions with your healthcare provider.
- We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
- AI features require an internet connection and may be temporarily unavailable due to service outages.
8. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to reverse engineer, decompile, or extract source code from the App.
- Interfere with or disrupt the App’s servers or networks.
- Create multiple accounts to circumvent free tier limits.
- Upload malicious content, spam, or inappropriate material.
- Impersonate another person or entity.
- Use automated tools to access the App (bots, scrapers, etc.).
9. Intellectual Property
- Fodify, its design, code, icons, and content are owned by Fodify and protected by copyright and trademark laws.
- The Fodify name, logo, and carrot icon are trademarks of Fodify.
- The FODMAP food database is compiled from public research sources and our own analysis. Individual ratings are our editorial work product.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Fodify is provided “AS IS” without warranties of any kind, express or implied.
- We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
- We are not liable for any health outcomes resulting from dietary decisions made using the App.
- Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold harmless Fodify from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
12. Termination
- You may delete your account at any time from Settings → Account → Delete Account.
- We may suspend or terminate your access if you violate these Terms.
- Upon termination, your right to use the App ceases immediately. Data deletion follows our Privacy Policy.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
